AGREEMENT AND POLICY ON PERSONAL DATA PROCESSING & USE OF IMAGES

(Applicable to contestants of the Star Awards Contest)

Pursuant to Decree No. 13/2023/ND-CP dated 17/04/2023 of the Government on personal data protection; and in order to secure the rights and obligations of the parties within the Star Awards contest (hereinafter the “Contest”), organised by Wilmar CLV Group together with 6 university clusters (Vietnam National University Hanoi, Thai Nguyen University, Hue University, The University of Da Nang, Vietnam National University Ho Chi Minh City, Can Tho University) and sponsored by the Simply Rice Bran Oil brand (hereinafter collectively the “Organising Committee” or the “OC”).

By ticking the box “I have read, fully understand and agree to the Contest Rules as well as the Personal Data Privacy & Collection Policy” on the online submission system, the Contestant confirms that they have read, fully understood and entirely voluntarily agreed to all of the following terms:

ARTICLE 1: SCOPE AND TYPES OF PERSONAL DATA COLLECTED

1.1. Basic personal data: Full name, date of birth, gender, contact details (phone number, email address), education details (the university/college currently attended, student card).

1.2. Image and audio data: Personal images (portrait, full scene), voice and any content appearing in the entry (video clip) submitted by the Contestant to the OC.

1.3. Digital interaction data: Interaction figures (likes, shares, comments, saves), scores and ranking of the Contestant on social platforms and on the official website of the Contest.

ARTICLE 2: PURPOSES OF PERSONAL DATA PROCESSING

The Organising Committee collects and processes the Contestant’s data for the following purposes:

2.1. Running the Contest: Identification, verification of eligibility, contact, marking, announcement of results and award of prizes under the Contest Rules.

2.2. Communication and promotion: Using images and entries to promote the Contest and to build employer branding for Wilmar CLV Group.

2.3. Marketing activities of the Sponsor: Incorporating images/entries into communication and advertising campaigns of the sponsoring brand Simply Rice Bran Oil and other lawful commercial activities.

ARTICLE 3: OWNERSHIP, USE OF ENTRIES AND FINANCIAL WAIVER

3.1. The Contestant voluntarily grants the OC, Wilmar CLV Group and the sponsoring brand a non-exclusive right, unlimited in territory and unlimited in time, to use the entire entry (video clip) and the personal images appearing therein.

3.2. The OC has full rights to use, reproduce, edit (including but not limited to cutting, compositing, adding logos, subtitles and effects), distribute, screen and publish the entry on every medium (Website, Fanpage, TikTok, YouTube, press, television...) and at related events.

3.3. The Contestant acknowledges and agrees that the grant of rights under Articles 3.1 and 3.2 is entirely free of charge. The OC, Wilmar CLV Group and the Sponsor are under no obligation to pay the Contestant any royalty, image usage fee or remuneration in any form.

ARTICLE 4: DATA TRANSFER AND SECURITY

4.1. The OC undertakes to apply the technical and security measures necessary to protect the Contestant’s personal data in accordance with the law in force.

4.2. The Contestant agrees to allow the OC to share and transfer personal data and entries to lawful third parties directly involved in running the Contest and exploiting the entries (including but not limited to: the Panel of Judges, technology/website partners, communication agencies, member companies of Wilmar CLV Group).

4.3. The OC undertakes not to sell, lease or exchange the Contestant’s personal data with any third party for commercial purposes outside the scope of Article 2 of this Agreement.

ARTICLE 5: UNDERTAKINGS AND RESPONSIBILITIES OF THE CONTESTANT

5.1. The Contestant undertakes and warrants that they are the author and/or the sole lawful owner of the entry; and that it infringes no intellectual property right, moral right or any other lawful right of any third party (including the audio, music, images and materials used inside the video clip).

5.2. Should any dispute or complaint arise in relation to copyright or the content of the entry, the Contestant shall bear full responsibility before the law and shall compensate for any damage caused to the OC, Wilmar CLV Group and the Sponsor.

5.3. The OC may unilaterally disqualify an entry and withdraw all prizes and titles (if any) at any time upon discovering a breach of the undertakings in this Article by the Contestant, and may require the Contestant to compensate for the actual damage incurred.

ARTICLE 6: STORAGE PERIOD AND EFFECT OF THE AGREEMENT

6.1. The Contestant’s personal data, images and entries shall be stored and used until a valid written request for deletion is sent by the Contestant to the OC, or as otherwise provided by the law in force. Such deletion (if any) does not affect the lawfulness of the uses of the data already carried out and published before that time.

6.2. This Agreement takes legal effect immediately from the moment the Contestant ticks the confirmation box on the electronic system of the Contest. That action has legal value and binding force equivalent to the Contestant’s physical/electronic signature.
